Abstract This article reconstructs the relationship between Christianity and human rights in accounts of constitutional law. The studies of Georg Jellinek and Martin Heckel reveal the political and cultural reasons for the acceptance and rejection of the human rights in protestant theology, which is dominated by a critical view of western liberal ideas. In contrast this article recommends the nexus of the ideas of human rights and democracy with a theological concept of liberty as a positive contribution of protestant theology that renounces exclusive theological reasons for the human rights.
